1. About these terms
These terms apply to the Gami Kids mobile app ("the app") provided under the name Gami Kids by Abdulgani Akyüz, an independent developer based in Türkiye (Kavacık Mah. Taman Sk. No: 10/4, Beykoz, İstanbul, Türkiye) ("we", "us"). By downloading or using the app you agree to these terms. The app is meant to be used by children under the supervision of a parent or legal guardian, and the parent or guardian accepts these terms on the child's behalf. Our Privacy Policy explains how we handle information.
2. Using the app
We give you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for private, non-commercial purposes. You agree not to copy, modify, resell or reverse-engineer the app, interfere with its servers or security, or use it in any unlawful way.
3. Parent account
A parent account is optional and may only be created by an adult. You are responsible for keeping your password safe and for activity in your account. Tell us straight away at help@gamikids.com if you think someone else has accessed it.
4. Premium subscriptions
- What you get: the first levels of every game, plus one selected later level in every game, are free. A Premium subscription unlocks all games and levels, extra Premium quests and the Premium parent features for as long as it is active.
- Plans and prices: monthly and yearly plans are offered. Prices are shown in the app and in the store you downloaded it from (Google Play or the Apple App Store) in your local currency, including any applicable taxes, before you confirm.
- Who can buy: purchases must be made by an adult (the parent or guardian) using their own store account.
- Payment: payment is charged to your Google Play account or Apple Account when you confirm the purchase (or when the free trial ends). We never see or store your card details.
- Automatic renewal: subscriptions renew automatically for the same period and price unless cancelled at least 24 hours before the end of the current period.
- Free trial: the yearly plan may include a 3-day free trial for eligible new subscribers. If you don't cancel at least 24 hours before the trial ends, the yearly subscription starts and is charged automatically.
- Cancelling: manage or cancel at any time in the store where you subscribed – on Android: Google Play → Payments & subscriptions → Subscriptions; on iPhone or iPad: Settings → your name → Subscriptions. Premium remains active until the end of the paid period. Deleting the app or your account does not cancel the subscription.
- Price changes: if the price changes, you will be informed in advance by Google Play or Apple as required, and you can cancel before the new price applies.
- Refunds: payments are processed by Google Play or Apple, and refunds are handled under that store's refund policy (Apple refunds can be requested at reportaproblem.apple.com). This does not affect any rights you have under the consumer laws of your country.
- Promotional access: we may sometimes give Premium through promotional codes. Such access lasts for the period stated with the code and can't be exchanged for money.
5. Virtual coins and items
Coins, stars and accessories in the app are earned only through play. They have no monetary value, can't be bought with real money and can't be exchanged or transferred.
6. Content and intellectual property
All games, characters, artwork, music, sounds and text in the app and on this website belong to us or our licensors and are protected by law. Gami Kids and the Gami Kids dino are our trademarks. Nothing in these terms transfers ownership to you.
7. Changes to the app
We continually improve Gami Kids and may add, change or remove games, levels or features. If we remove a significant part of Premium during a paid period, we will try to offer something of similar value. We may update these terms; if the changes are important, we will let you know in the app before they take effect.
8. Availability and liability
We work hard to keep Gami Kids running smoothly, but we cannot guarantee that it will always be available or free of errors. To the extent permitted by law, the app is provided "as is" and we are not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
9. Ending your use
You can stop using the app and delete your account at any time (see Delete account). We may suspend access if these terms are seriously breached, for example in case of attempts to break the app's security.
10. Governing law
These terms are governed by the laws of the Republic of Türkiye. Consumers may apply to the consumer arbitration committees and consumer courts in Türkiye. If you live in the EU or UK, you also keep the protection of the mandatory consumer laws of your country and may bring claims in your local courts.
11. Additional terms for the Apple App Store
If you downloaded Gami Kids from the Apple App Store, Apple's Licensed Application End User License Agreement also applies, and the following terms apply in addition to the sections above:
- These terms are between you and us, not with Apple. We, not Apple, are solely responsible for the app and its content.
- Your licence is limited to using the app on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules.
- We are solely responsible for maintenance and support of the app. Apple has no obligation to provide any maintenance or support.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer protection or privacy claims.
- If a third party claims that the app infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and Apple has the right to enforce them against you.
